Overview

The Children’s National Patient Portal (“Patient Portal”) is provided as a service by Children’s National Medical Center ("Children’s National"), your healthcare provider. This page explains the rights and requirements of visitors and users of Children’s National’s Patient Portal. The Patient Portal offers access to your Electronic Medical Record ("EMR") which is maintained by Children’s National and gives you a secure way to access your medical records, schedule appointments, review immunization history, view medications, and communicate with your Provider.

The Patient Portal is governed by these Terms of Use (“Terms”). These Terms cover all content, users and appropriate uses of Children’s National’s Patient Portal. The definition of content includes all text and visuals (e.g., photographs, graphics, and videos). Your use of the Patient Portal is conditioned on your acceptance of these terms without modification or subject to any conditions. Where noted on the Patient Portal, additional conditions, restrictions, and privacy policies may be required to access accounts, content, or services.

If you do not agree to these Terms, you, and or your designated representative, may not establish a Patient Portal account or access the Patient Portal. By using or accessing the Patient Portal you agree to be bound by these Terms.

Patient Portal Privacy Policy

Children's National is committed to maintaining the privacy of visitors and users of the Patient Portal.

This policy explains the collection and use of your personal information when you visit and use the Patient Portal. Online services include, but are not limited to, Children's Doc2Doc Messaging System, live web chats, Request an Appointment, Ask a Doctor, and all existing forms submitted through the websites. This policy is also available in Spanish.

Any updates to this privacy statement, including new features or services, or changes in privacy practices, will always appear on our websites.

Privacy of Children

We are committed to protecting the privacy of children. Our website and Patient Portal are intended for adults and adolescents age thirteen (13) and over. It is not intended for or designed to attract adolescents under the age of thirteen (13). We do not permit registration by, nor do we collect personally identifiable information from, any adolescent we know to be under the age of thirteen (13).

Modification of Terms of Use

Children’s National may revise these Terms and Notice of Privacy Practices (“Privacy Policy”) at any time. You are responsible for regularly reviewing these Terms and the Privacy Policy. A revised Terms of Use and Privacy Policy are effective upon posting, and your continued use of the Patient Portal indicates your acceptance to a revised Terms of Use or Privacy Policy.

Accessing Children’s National Patient Portal

Access to the Patient Portal is voluntary and information, personal or otherwise uploaded or added to the Patient Portal by you is contributed at will.

You must be at least 13 years old to establish a Patient Portal account with Children’s National. You may not permit any other person to access the Patient Portal using your user name and password. The security of your password and the use of your account is your responsibility. If you learn or suspect that your user name or password has been wrongfully used or disclosed, you should promptly notify Support at 1-877-621-8014 and immediately reset your password.

Using Children’s National Patient Portal

You agree not to post or transmit any information through the Patient Portal that infringes on the rights of others, or violates their privacy.

You may not use the Patient Portal for any purpose that is unlawful, immoral, or is otherwise prohibited by these Terms. You may not use the Patient Portal in any manner which could damage, disable, overburden, or impair the Patient Portal or interfere with any other party's use and enjoyment of the Patient Portal. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided to you through the Patient Portal.

Maintaining Another Person's Connection

If you are legally authorized to view another person's health information, their Provider may give you access to the Patient Portal for that person, subject to these Terms.

Proxy Use of Children’s National Patient Portal

You may authorize a proxy(ies) to view and interact with the Patient Portal.You may authorize any person who qualifies for a Patient Portal account, including a minor, to be a proxy.

If you have agreed to allow a minor to be a proxy, you agree that you shall be solely responsible for: (a) acceptance of these Terms on the minor's behalf, (b) the minor's compliance with these Terms, (c) the on-line conduct of such minor; (d) monitoring such minor's access to and use of the Patient Portal; and (e) the consequences of such minor's use. Access or privileges you give to someone can be modified or removed by you at any time, for any reason.

When you share information from the Patient Portal with another individual, you acknowledge and accept responsibility for the decision to provide that individual with access to protected health information.

Disclosure of Information

Children’s National may, in our sole and reasonable discretion, disclose information contained within the Patient Portal to satisfy applicable law, regulation, legal process or governmental request.

The Patient Portal does not replace medical advice or treatment from a healthcare professional. By using the Patient Portal, you also acknowledge and agree to the following:

  • You use the Patient Portal at your own risk and assume all responsibility for doing so.

  • The inclusion of content does not necessarily mean or warrant any particular service, treatment or product is safe, appropriate or effective for you or your child.

  • The Patient Portal is provided “as-is.” Children’s National does not guarantee or warrant against errors in the accuracy, timeliness, and completeness of any online content.

YOU UNDERSTAND AND AGREE THAT CHILDREN’S NATIONAL’S PATIENT PORTAL, CONTENT OR INFORMATION CONTAINED ON OR PROVIDED BY CHILDREN’S NATIONAL’S WEBSITES IS PROVIDED ON AN "AS IS" BASIS. CHILDREN’S NATIONAL DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORsem*nTS WHATSOEVER WITH REGARD TO THE INFORMATION OR SERVICE PROVIDED THROUGH THE PATIENT PORTAL. CHILDREN’S NATIONAL DOES NOT GUARANTEE THAT USE OF THE PATIENT PORTAL WILL BE FREE FROM TECHNOLOGICAL DIFFICULTIES INCLUDING, BUT NOT LIMITED TO, UNAVAILABILITY OF INFORMATION, SERVICE DISRUPTIONS, VIRUSES OR WORMS, AND YOU UNDERSTAND THAT YOU ARE RESPONSIBLE FOR IMPLEMENTING SUFFICIENT PROCEDURES TO SATISFY YOUR PARTICULAR REQUIREMENTS FOR ACCURACY OF DATA INPUT AND OUTPUT.

Limitations of Liability

Nothing contained in the Patient Portal is intended to be relied upon as a medical diagnosis or for treatment. The information should not be considered complete, nor should it be relied on to suggest a course of treatment for a particular individual. It should not be used in place of the advice of your Provider or other qualified healthcare provider.

The use of the site is entirely at your own risk, and in no event shall Children’s National be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or any other monetary or other damages, fees, fines, penalties, or liabilities arising out of or relating in any way to this service, or sites accessed through the Patient Portal. Your sole and exclusive remedy for dissatisfaction with the service is to stop using the service.

Users release Children's National, its affiliates, officers, directors, employees and representatives from any and all liabilities, including but not limited to attorneys’ fees and costs and indirect, consequential, exemplary, special and punitive damages, arising from user's use of the Patient Portal. You agree that you will indemnify and hold harmless Children's National against any damages, losses, injuries, liabilities, judgments, costs or expenses (including reasonable attorneys' fees and costs) arising out of a claim by a third party relating to any material that you have posted or other actions taken by you on the Patient Portal.

TERMINATION OF USE

Children’s National reserves the right to change, suspend or discontinue all or any aspects of the Patient Portal at any time without prior notice, unless noted otherwise.

Third Party Websites

The Patient Portal may contain links to sites operated by third parties including, but not limited to, third party sites that may display the Children’s National trademarks. These links are available for your convenience and for no other purpose.

Children’s National does not warrant or make any representation about the substance, quality, functionality, accuracy, or fitness for a particular purpose, merchantability, or any other representation about any third party site or its content. A link to a third party site through the Patient Portal does not constitute sponsorship, endorsem*nt, approval, or responsibility for any third party site.

The terms of use and privacy policy of any third party site may differ substantially from the terms of use and privacy policies for the Patient Portal. Before using a third party site, please review the terms and privacy policy of use for these sites.

Information We Collect

General Use

To monitor site usage and improve its quality, we gather general information about the use of the Patient Portal. We collect information from its users in three ways: (a) from Web server logs, (b) with cookies and (c) directly from the user.

(a) IP Addresses (Server Log Information)

An IP address is a number automatically assigned to your computer whenever you access the Internet. All computer identification on the Internet is conducted with IP addresses, which allow computers and servers to recognize and communicate with each other. The Patient Portal collects IP addresses in order to conduct system administration, report aggregate information to affiliates, subsidiaries, sponsors, advertisers or partners, and to conduct site analysis. The Patient Portal will also use IP addresses to identify any users who refuse to comply with the Patient Portal’s Terms of Use Agreement, and to identify users who threaten the Patient Portal’s service, site, user, clients or others.

(b) Cookies

The Patient Portal places a text file called a "cookie" in the browser files of your computer. Cookies are pieces of information that a Web site transfers to an individual's hard disk for record keeping purposes. The Patient Portal uses cookies during your online session to deliver content specific to your interests. Cookies allow Children’s National to avoid showing you the same message repeatedly.

(c) Web Analytics

The Patient Portal may use Google Analytics to understand site usage. Site usage information is used to help design, develop, and support the Portal. To the extent the Patient Portal uses Google Analytics, Google receives and stores the Patient Portal’s contributed site usage information (such as pages accessed), but it does not receive any individually identifiable or sensitive information as a part of this process. If you do not want data collected by Google Analytics, you can use the Google Analytics Opt-out Browser Add-on available on Google's website.

(d) Registration (User-Supplied Information)

The Patient Portal’s site registration requires users to input contact information such as their name and e-mail address, and demographic information such as organization and/or role. The user's contact information is used to contact the user when necessary. Users may choose (opt-in) to receive future mailings. The Patient Portal uses this data to tailor the user's experience, showing the user content that reflects their stated preferences. This information may be shared with Children’s National’s business associates.

Information to Process Transactions

When you use our website to make appointments, register for events, purchase products or services, or join groups, we only collect information necessary to process the transaction. This may include your name, address, telephone, and fax numbers, e-mail address, and credit card number or other payment information.

This information is encrypted to assure that your private information is transmitted in a secure fashion, but please understand that no one can guarantee that unlawful or inappropriate use by third parties will not happen. Please see "Use of Information" for details of how we use some of this information for other purposes.

Payment Information

If we collect information for payment purposes, it is stored and used by us or by others we contract with to process orders for that transaction only.

Use of Information

We may use your e-mail address, address, fax number or other information to confirm a transaction, verify your identity, send you general information such as newsletters, or for similar purposes, either directly or through vendors we contract with. In some cases, you will be given the choice not to have your information used for some of these purposes. In those cases, you will be provided with information on how to opt out.

We will not disclose any information to third parties for any other purpose, and we will not sell mailing lists.

Children’s National has established a written Identity Theft Prevention Program and has taken steps to train our staff on measures to protect patient accounts.

General

These Terms are governed by US federal law or the laws of the District of Columbia. You hereby consent to the exclusive jurisdiction and venue of courts in the District of Columbia, U.S.A. in all disputes arising out of or relating to the use of the Patient Portal. Use of the Patient Portal is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph.

If any part of these Terms are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect.

Notice

Children’s National may deliver notice to you by means of electronic mail, a general notice on the Patient Portal, or by written communication delivered by first class U. S. mail to your address on record in the Patient Portal account information. You may give notice to Children’s National at any time via electronic mail to privacyofficer@childrensnational.org or by letter delivered by first class postage prepaid U. S. mail or a nationally recognized overnight courier to the following address:
